In the following terms & conditions “the photographer” shall mean Joel Hirst trading as Joel Hirst Photography “The client(s)” shall be those persons defined in the booking form commissioning the photographer including any affiliates. It is mutually agreed that the following terms of agreement form an integral part of booking the photographer and cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing. By booking with the photographer you agree to the below Terms and Conditions.
Please note: By booking a Joel Hirst Photography service, you automatically agree to these terms and conditions. If you wish to discuss the agreement, please contact Joel Hirst.
1. Bookings
1.1 A non-refundable deposit is required at the time of booking in order to reserve and secure the date & time of the service unless otherwise confirmed by Joel Hirst Photography in writing. This is part of the booking process.
1.2 The deposit amount will be stated in your booking request acknowledgement email. Payment must be paid by bank transfer and will be stated in invoice.
1.3 All images are subject to a 1-2 week post processing time unless otherwise agreed by Joel Hirst.
2. Payments
2.1 Balances owed for Joel Hirst Photography services must be paid in full upon receipt of invoice. Invoice will be issued with digital transfer of sample photo album upon which any outstanding monies will be owed immediately.
2.2 Payment for all extra items ordered must be made at the time of ordering. Prices for prints, copyright release and digital copies are available upon request.
2.3 Joel Hirst Photography reserves the right to cancel any bookings without notice if the required deposit is not paid within the 7 day period, unless agreed otherwise in writing.
3. Prices
3.1 All charges and additional services specified on the booking form are supplied at the prices ruling on the date of booking. Services not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.
4. Display & Publishing
4.1 The client(s) hereby allow(s) Joel Hirst Photography and associates to display any photograph / video covered by this contract and to generally promote the business in all forms of media platforms including digital, print and social media.
5. Licence, Coverage & Reproduction
5.1 Photographs taken during the course of the session/event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.
5.2 The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer’s judgement regarding these matters shall be deemed correct.
5.3 When attending events the photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.
5.4 At certain venues, the photographer’s movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the event may not be the photographer’s choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
5.5 Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
5.6 Upon the unlikely event of a mass loss of data or file corruption the photographer can only accept liability to return all payment made as a result of the booking.
6. Creative Licence
6.1 The entire copyright and intellectual property of all media materials created by or for the Photographer shall vest in and be retained by the Photographer at all times unless directly purchased from the photographer.
6.2 Joel Hirst Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. Joel Hirst Photography’s judgement on photographic style and the number of photographs taken shall be deemed correct.
6.3 Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. Joel Hirst Photography will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
7. Obstructions & Limitations
7.1 The Client(s) must agree to give the photographer full precedence over any event attendees in order to capture the images required for the service provided.
7.2 The photographer cannot be held liable for a lack of images due to the obstruction of other persons or lack of persons attending event.
7.3 The photographer may at times be limited by venue management as to what can and cannot be done. The client must accept that the photographer will work to be best of their ability, however is not liable for lack of images due to limitations put in place by venue management.
7.4 It is advised that the client(s) make themselves aware of any limitations that may be put in the photographer's way and advise the photographer prior to the day.
8. Cancellations
8.1 If cancellations are made 4 weeks before the booked date, all monies will be refunded including the deposit.
8.2 If cancellations are made 2 weeks before the booked date, all monies will be refunded excluding the deposit.
8.3 If cancellations are made 1 week before the booked date, a 50% 'service price' or cancellation fee based on the amount of the booking price agreed is due & deposit is non-refundable.
8.4 Any "add on" services e.g printing will be refunded at the discretion of Joel Hirst Photography.
8.5 All booking cancellations must be made in writing to Joel Hirst.
These terms and conditions may need updating at any time. If this occurs after your booking has been taken, however before your service has been provided you will be notified in writing. If you do not agree to the new Terms & Conditions you have 7 days from the date the email was sent to contact Joel Hirst Photography to discuss the amendments. If you do not contact Joel Hirst Photography within 7 days of being notified you will be legally bound by the changes.
9. Storage of Media
9.1 The clients media will be held on the photographers personal storage for 1 month after the initial digital transfer, the client should take the necessary steps to store and duplicate any media to avoid any loss of materials.
9.2 The photographer has the right to delete any files remaining after the 1 month grace period.
9.3 The photographer will not be responsible for the client losing any material.
